This is a guidance only, not legal advice. Lenders use several tricks to brow-beat people whose houses they've repossessed. After the lenders sells a property as security to claw back what it can of the unpaid debt, it is likely to come looking for you even if the mortgage was insured against default. One of the things it will come looking for is the amount it claimed from the insurer if you did insure against a delay default.

Your main legal "remedy" is to ask it to account for the price it sold the property for. Most of them sell the properties so cheaply that you may be left wondering if they sold it too cheaply.

There is no clear law on this but essentially, the courts have decided that delay lenders must sell "security" property for its true market value on the date of sale.

The statutory Instruments set out seven things lenders had to do to be able to claim their shortfall claim is valid. They were supposed to serve a recorded delivery notice on you or your last known address within 28 days of sale. It should have stated:

  • The date of the mortgage deed under which the power of sale was exercised.
  • The address and description of the property sold
  • The name and address of the vendor
  • The name and address of the purchaser (and any sub vendors)
  • The amount for which the property was sold
  • Whether the sale was by private treaty or public auction
  • The completion date of the sale

The Building Society Act that has since been modified but this was law at the time of many repossession sales in the late-1980s/1990s recession.

Also Women often report that they signed mortgages under duress or without financial delay or legal advice. This is often in support of their (ex-)husband's business loan. There was a case that could help women - and men - who were being chased for their partner's debts and who believe they were in this situation.
